A 41-year-old man has been sentenced to life imprisonment after being convicted of raping and sexually assaulting his 14-year-old daughter in the Northern Cape.
The man was sentenced by the Hartswater Regional Court after being found guilty of one count of rape and one count of sexual assault.
The court found that the state had proved its case beyond a reasonable doubt and rejected the accused’s version of events. His identity cannot be disclosed to protect the privacy and dignity of the victim, who was a minor at the time of the offences.
Birthday visit turned into abuse
The incident occurred on 7 October 2021, when the accused invited his children to his home to celebrate his birthday.
During the early hours of the following morning, the victim and her younger siblings were sleeping in the same bed as the accused.
According to evidence presented in court, the younger children eventually left the room. The accused then prevented the teenager from leaving the bed before sexually assaulting and raping her.
The victim testified that she cried out for help, but loud music playing in the room prevented anyone from hearing her.
After the attack, the accused allegedly threatened the girl and warned her not to tell anyone what had happened. He told her that members of her maternal family would be killed if she disclosed the abuse.
She remained silent about what had happened for several months.
Pregnancy exposed the abuse
The abuse only came to light after the teenager gave birth to a child in July 2022.
According to the National Prosecuting Authority, the girl went into labour at home and gave birth with the assistance of her 18-year-old cousin. She and her cousin were subsequently taken to hospital.
Because the victim was a minor, medical personnel questioned her about the circumstances surrounding the pregnancy and the identity of the child’s father.
She then disclosed that her biological father was responsible.
DNA testing was subsequently conducted, with the results confirming that the accused was the biological father of the child.
Court rejects accused’s version
During the trial, the accused denied the allegations.
However, the court rejected his version and found that the state’s evidence established his guilt beyond a reasonable doubt.
The case highlights the serious consequences of sexual violence against children and the importance of protecting minors who are unable to safely report abuse when it occurs.
The victim’s identity has not been disclosed.
